PART 1 GENERAL TERMS
After-Sales Policy (“Policies”) only apply to Timekettle products you purchased from Timekettle authorized retailers for your own use and not for resale.
WHAT IS COVERED
Timekettle warrants that products you purchase will be free from material and workmanship defects under normal use during warranty period. The warranty period for a products is effective on the day such product is delivered, or otherwise guided by Timekettle. Please refer to “PART 3 AFTER-SALES SERVICE TYPES” for your warranty period and after-sales service types.
HOW TO OBTAIN WARRANTY SERVICE
If a product does not function as described during the warranty period, please contact Timekettle for after-sales service.
Please be advised that Timekettle may not provide after-sales service in certain regions, and the after-sales service policy may differ in different regions.
Charges may apply for services not covered by warranty. Please contact Timekettle for information specific to your region.
WHAT TO DO BEFORE OBTAINING AFTER-SALES SERVICE
Follow the procedures specified by Timekettle;
Backup and secure all data contained in your product;
Provide Timekettle sufficient, free, and secured access to your product for after-sales service;
Remove all additional parts, alterations, and attachments not covered under warranty;
Make sure that the product or part is free of any legal restrictions that prevent its replacement;
If you do not have ownership of the product, please obtain authorization from the owner for Timekettle to provide warranty service.
WHAT WILL TIMEKETTLE DO
Please contact Timekettle, and explain the problem with the product, in details.Timekettle will attempt to diagnose and resolve the problem by telephone, and E-mail.If your problem cannot be resolved through over the telephone and E-mail, you may be required to deliver the product to Timekettle for further examination. Timekettle will arrange for proper service type for repair, specified in “PART 3 - AFTER-SALES SERVICE TYPE”.
PRODUCT AND PART REPLACEMENT
If after-sales service involves the replacement of a product or part, the replaced product or part becomes property of Timekettle, and the replacement product or part becomes your property. Only unaltered Timekettle products and parts are eligible for replacement.
The replacement products or parts provided by Timekettle may not be entirely new, but they are certainly in good working order and at least in performance equivalent to the parts being replaced. The replaced product or accessory has the same warranty service during the remaining warranty period of the original product.
USE OF PERSONAL CONTACT INFORMATION
If you obtain service under this repair policy, you are automatically consented to authorize Timekettle to store, use, and process your translation data and your contact information, including names, phone numbers, addresses, and E-mail addresses. You agree and understand that it is necessary for Timekettle to collect, process, and use these data to perform service under this policy. Timekettle may contact you to inquire about your satisfaction with our service or to notify you about any product recalls or safety issues. You authorize Timekettle to transfer your information to any country where we provide products and services, and to entities acting on our behalf. Timekettle may also disclose your information where required by law.
WHAT THIS AFTER-SALES POLICY DOES NOT COVER
This policy does not cover the following:
× Crashes or fire damages caused by non-manufacturing factors;
× Damages caused by unauthorized modification, disassembly, or shall opening not in accordance with official instructions or manuals;
× Damages caused by improper installation, incorrect use, or operation not in accordance with official instructions or manuals;
× Damages caused by incorrect repair by customer not in accordance with official instructions or manuals;
× Damage caused by unauthorized modification of circuits, and mismatch or misuse of the battery and charger
× Damages caused by unauthorized third party accessories;
× Error-free operation of a product;
× Loss of, or damage to, your data by a product;
× Any software programs,whether installed at random or subsequently;
× Failure of, or damage caused by any third party products;
LIMITATION OF LIABILITY
Timekettle is responsible for loss or damage to your product only while it is in transit.Timekettle is not responsible for loss or disclosure of any data, including confidential information, proprietary information, or personal information, contained in the product.Under no circumstance, and notwithstanding the failure of essential purpose of any remedy set forth herein, shall Timekettle, its affiliates, suppliers, resellers, or service providers be liable for any of the following, even if informed of their possibility and regardless of whether the claim is based in contract, warranty, negligence, strict liability or other liabilities: 1) third party claims against you for damages; 2) loss, damage or disclosure of your data; 3) special, incidental, indirect or consequential damages, including but not limited to lost profits, business revenue, goodwill or anticipated savings. In no case shall the total liability of Timekettle, its affiliates, suppliers, resellers, or service providers for damages from any cause exceed the amount of actual direct damages, not to exceed the amount paid for the product.
The foregoing limitation does not apply to damages for bodily injury (including death), damage to real property or damage to tangible personal property for which Timekettle is liable under law.
As some countries, regions, or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the above limitation or exclusion may not apply to you.
YOUR OTHER RIGHTS
This warranty provides you with extra and specific legal rights. You may have other rights according to the applicable laws of your country/region, or jurisdiction. You may also have other rights under a written agreement with Timekettle. Nothing in this Warranty affects your statutory rights, including rights of consumers under laws or regulations governing the sale of consumer products that cannot be waived or limited by agreement.
This after-sales service policy applies ONLY to Mainland China, other countries and regions may vary according to local laws and regulations.
